1. About the Website
(a) Welcome to www.rararooms.com.au (Website). The Website facilitates interactions between:
(i) parties providing services (Hosts); and
(ii) parties receiving services (Guests),
making it easier for the Guests and the Hosts to locate, communicate, arrange payment and deliver the services in a fast and secure manner (Services).
(b) The Website is operated by Rara Rooms (ACN 692 067 397). Access to and use of the Website, or any of its associated products or Services, is provided by Rara Rooms. Please read these terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of its products or Services, immediately.
(c) Rara Rooms reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Rara Rooms updates the Terms, it will use reasonable endeavours to provide you with notice of updates. Any changes take immediate effect from the date of publication. We recommend you keep a copy of the Terms for your records.
2. Acceptance of the Terms
You accept the Terms by registering for the Services and/or making any payment as required under the Terms. You may also accept the Terms by clicking to accept or agree where this option is made available in the user interface.
3. The Services
(a) To access the Services, both the Guest and the Host must register for an account through the Website (Account).
(b) You may be required to provide personal information, including:
(i) Email address
(ii) Preferred username
(iii) Telephone number
(iv) Password
(c) You warrant that all information provided is accurate, correct and up to date.
(d) Upon registration, you become a Member and agree to be bound by the Terms.
(e) You may not use the Services or accept the Terms if:
(i) You are not of legal age to form a binding contract with Rara Rooms; or
(ii) You are barred from receiving the Services under applicable law.
4. Your Obligations as a Member
As a Member, you agree to:
(a) Not share your profile with any other person.
(b) Use the Services only for permitted purposes under:
- the Terms; and
- applicable law and guidelines.
(c) Protect the confidentiality of your password and email address.
(d) Notify Rara Rooms of any unauthorized use or breach of security.
(e) Not impersonate another Member or use another Member's profile.
(f) Ensure Your Content is accurate and documented.
(g) Not harass, impersonate, stalk, or threaten other Members.
(h) Use the Website solely for your own use.
(i) Avoid unauthorized commercial use unless approved by Rara Rooms.
(j) Not collect emails or link to the Website without permission.
(k) Accept that Rara Rooms may remove solicitations or ads.
(l) Not use automation on the Website.
(m) Accept Rara Rooms' right to moderate or remove content.
(n) Use the Website lawfully and without disruption.
5. Using the Website as the Guest
Guests create an account, browse listings, submit a booking, pay securely, receive confirmation, communicate with Hosts, and leave a review after their stay.
6. Using the Website as the Host
Hosts create an account, complete verification, list their property, manage bookings, receive payments, communicate with Guests, and comply with legal obligations.
7. Payment
(a) By using Rara Rooms, you agree that:
- Guests pay at the time of booking via Rara Rooms' secure platform.
- Hosts receive payouts after Guest check-in, minus any applicable service fees.
(b) All payments are processed via Stripe. By using the Website or Services, you agree to the Stripe terms and conditions.
(c) Rara Rooms’ service fees are inclusive of GST where applicable.
8. Refund Policy
(a) Refunds are managed in line with Australian Consumer Law and any applicable Host cancellation policy. These rights are in addition to statutory rights.
(b) Payments are processed securely via Stripe. Funds are held until a stay is completed or cancelled. Refund eligibility is determined by the Host’s cancellation policy and the timing of the Guest’s request. By booking, Guests agree to the Host’s published cancellation policy.
(c) Refunds may be issued if:
- The Guest cancels within the Host's published policy window.
- The accommodation was materially misrepresented.
- Unforeseen events (e.g., natural disaster or government restrictions) prevent the stay.
(d) Once funds are released to the Host, Rara Rooms will review refund requests case-by-case.
(e) Rara Rooms service fees are non-refundable unless required by law. Approved refunds are initiated within 5–10 business days.
(f) Refund disputes are reviewed by Rara Rooms, and final decisions are made in line with these Terms and applicable law.
9. Copyright and Intellectual Property
(a) All content on the Website is protected by copyright under Australian law and international treaties.
(b) Rara Rooms grants you a non-exclusive, royalty-free license to:
- Use the Website under the Terms.
- Store Website content in your device cache.
- Print pages for personal, non-commercial use.
(c) No rights are transferred to you in relation to trademarks, patents, or designs.
(d) You may not broadcast, republish, or adapt Services or third-party content without permission.
(e) By posting Your Content, you grant Rara Rooms a perpetual, worldwide license to use it.
(f) You warrant that Your Content does not infringe third-party rights and agree to indemnify Rara Rooms.
10. Privacy
Your data is subject to Rara Rooms' Privacy Policy, available on the Website.
11. General Disclaimer
(a) Nothing in the Terms limits rights under Australian Consumer Law.
(b) Rara Rooms excludes all other warranties and is not liable for indirect or consequential loss.
(c) Use of the Website is at your own risk. Services are provided "as is" without warranty.
(d) Rara Rooms is not liable for Member conduct or misuse of Your Content.
12. Competitors
If you are in the business of providing similar Services for commercial gain, you are a competitor of Rara Rooms. Competitors may not use or access any information or content on the Website. Breach of this clause may result in legal action, including claims for injunctive relief, damages, and recovery of profits obtained through unauthorised use.
13. Limitation of Liability
(a) Rara Rooms' total liability is limited to resupply of Services.
(b) Rara Rooms is not liable for loss of profit, goodwill, or reputation.
(c) Rara Rooms is not liable for damages resulting from Your Content.
14. Termination of Contract
(a) You may terminate the Terms by providing 7 days' written notice via email to admin@rararooms.com.
(b) Rara Rooms may terminate the Terms if:
- You breach the Terms.
- Required by law.
- Services are no longer viable.
- You receive multiple complaints.
(c) Rara Rooms may suspend or cancel your membership without notice.
(d) Rights and obligations that survive termination remain in effect.
15. Indemnity
You agree to indemnify Rara Rooms against:
- Claims arising from Your Content.
- Consequences of using the Website.
- Breach of the Terms.
16. Dispute Resolution
16.1 Compulsory
No legal proceedings may commence unless the following steps are followed.
16.2 Notice
A party must give written notice of the dispute, desired outcome, and resolution steps.
16.3 Resolution
(a) Parties must attempt resolution within 28 days.
(b) If unresolved, a mediator is appointed via the Resolution Institute.
(c) Costs are shared equally.
(d) Mediation is held in Perth, Australia.
16.4 Confidential
All negotiations are confidential and treated as "without prejudice."
16.5 Termination of Mediation
If unresolved after 2 months, either party may terminate mediation.
17. Venue and Jurisdiction
Disputes are resolved in the courts of Western Australia, Australia.
18. Governing Law
The Terms are governed by the laws of Western Australia, Australia.
19. Severance
If any part of the Terms is void or unenforceable, the remainder remains in force.
